Welcome to FluxCoinEx. These Terms and Conditions govern your use of our financial exchange services including cryptocurrency, foreign exchange, and precious metals. By accessing our platform or using our services in Cape Town, South Africa, you agree to be bound by these formal legal terms.

1. Acceptance of Terms

By utilizing any service provided by FluxCoinEx, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must immediately cease all use of our services.

2. Eligibility to Use Our Services

Services are available only to individuals who are at least 18 years of age and possess the legal capacity to enter into binding contracts. Users must reside in a jurisdiction where our financial services are legally permitted.

3. Description of Services

FluxCoinEx provides an exchange platform for Digital Assets (Cryptocurrencies), Foreign Fiat Currencies (FX), and Precious Metals (Gold). We act as a service provider faciliting the transfer and exchange of these asset classes.

4. Exchange Rates and Pricing

Critical Market Notice: Cryptocurrency prices, foreign exchange rates, and precious metal values are subject to extreme market fluctuations and may change without notice. FluxCoinEx does not guarantee specific exchange rates until a transaction is finalized. Rates are derived from global market data and our internal liquidity providers.

5. Payments and Settlement

All payments must be made in the agreed-upon currency or asset. Settlement times vary based on the asset class and banking protocols. FluxCoinEx makes no guarantees regarding the precise timing of external blockchain confirmations or bank transfers.

6. Customer Responsibilities

Users are responsible for maintaining the security of their account credentials and for providing accurate wallet addresses or bank details. FluxCoinEx is not liable for losses resulting from user error, including sending assets to incorrect addresses.

7. Identity Verification (KYC)

To comply with South African regulatory standards, FluxCoinEx requires all users to undergo a Know Your Customer (KYC) process. This involves providing government-issued identification and proof of residence before high-value transactions are initiated.

8. Anti-Money Laundering (AML) Compliance

FluxCoinEx maintains strict AML policies. We monitor transactions for suspicious activity and reserve the right to report suspected illegal conduct to the South African Financial Intelligence Centre (FIC) without notice to the user.

9. Prohibited Activities

Users are prohibited from using FluxCoinEx for money laundering, terrorism financing, fraud, market manipulation, or any other illegal activity. Use of our services for darknet marketplace transactions is strictly forbidden.

10. Transaction Processing

All transaction requests are subject to approval. We reserve the right to delay or cancel any transaction deemed irregular or which fails our security verification protocols. We make no guarantees regarding transaction completion times.

11. Cancellations and Refunds

Due to the immutable nature of blockchain technology and the volatility of exchange markets, most transactions are final. Refunds are only considered in exceptional circumstances and at the sole discretion of FluxCoinEx management.

12. Risk Disclosure

Trading in cryptocurrencies, gold, and currencies involves significant risk. Market prices are volatile and you could lose your entire capital. FluxCoinEx does not provide investment advice and shall not be held liable for any market losses incurred by the user.

13. Limitation of Liability

FluxCoinEx and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services, including losses caused by market fluctuation or technological failure.

14. Intellectual Property

All content on the FluxCoinEx platform, including logos, text, graphics, and software, is the property of FluxCoinEx and is protected by South African and international intellectual property laws.

15. Privacy and Data Protection

We handle personal data in accordance with the Protection of Personal Information Act (POPIA). By using our services, you consent to the collection and processing of your data as described in our Privacy Policy.

16. Third-Party Services

Our platform may interact with third-party banking and blockchain services. We do not control these services and are not responsible for their performance or reliability.

17. Changes to These Terms

FluxCoinEx reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website, and your continued use of our services constitutes acceptance of the modified terms.

18. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the South African courts.
